There are so many employers and HR professionals now-a-days that misclassify Independent Contractors as employees, its nothing new. Whether they are doing this purposly or accidently, the fines and penalties can be costly.

I constantly get asked about how can I tell if he/she is an independent contractor. Well let me tell you what I tell everyone else, You Can’t! There is not set definition of the terms “independent contractor” for all purposes. The issue of whether a worker is an employee or independent contractor depends on the particular area of law to be applied.
